Marriage in Kuwait for Foreigners: Current Requirements and Documents

Foreign residents can conclude a marriage contract in Kuwait through the competent Ministry of Justice office, subject to the legal requirements applicable to their religion, nationality, residency status, and personal circumstances.

The documents and procedure may differ between Muslim marriages, non-Muslim contracts, and the ratification of a marriage concluded outside Kuwait. Applicants should therefore confirm the current requirements with the Ministry of Justice before attending.

Marriage contract inside the court

Kuwait Government Online states that the in-court marriage service is available to both Kuwaitis and non-Kuwaitis. The husband, the wife, the wife’s guardian, and two witnesses must attend, unless a legally valid special power of attorney applies.

Documents commonly required

  • Civil ID or Kuwaiti nationality certificate for Kuwaiti applicants.
  • Civil ID or passport for resident applicants.
  • Divorce certificate if the woman was previously divorced.
  • Inheritance certificate where the woman is widowed or the guardian is deceased.
  • A special power of attorney where applicable.
  • Permission from the employer where the husband is serving in the military.
  • Other documents requested according to the parties’ status and the circumstances of the application.

The official service page directs applicants to the documentation offices at the Ahmadi Court Complex or the Al-Riq‘i Court Complex, where the application is completed and the prescribed fee is paid.

Non-Muslim marriage documentation

The Ministry of Justice provides a separate documentation procedure for non-Muslims belonging to recognised monotheistic religions. The listed requirements include the original Civil IDs, two male witnesses, and—in the case of a marriage contract—a certificate from the relevant church or embassy confirming the parties’ marital status. The certificate must be translated into Arabic and authenticated by the Kuwaiti Ministry of Foreign Affairs.

Where a marriage contract was issued outside Kuwait, the original contract must generally be translated into Arabic and authenticated through the competent authorities before it can be ratified in Kuwait.

Important practical points

  • Requirements may differ according to nationality, religion, previous marital status, residency status, and the place where the original contract was concluded.
  • Do not rely on old online lists of documents or office hours; verify the current procedure before attending.
  • Bring original documents as well as copies, and arrange certified Arabic translations and foreign-affairs authentication where required.
  • A marriage certificate issued or ratified by the competent authority should be retained for use in residency, civil-status, and other official procedures.
